Scope: Online shop, voucher shop, sports equipment rental, consulting services, in-store sales
Governing law: Austrian law (KSchG, FAGG, ABGB, UGB)
A. General Provisions
1 Scope
These GTC apply to all contracts, deliveries, and services of Sport Fleiss GmbH via:
Online shop
Voucher shop
Booking platform (sports equipment rental)
Consulting services
In-store sales
Deviating terms and conditions of the customer are not recognized unless Sport Fleiss has expressly agreed in writing.
2 Conclusion of Contract
The display of products, vouchers, or rental items in the online shop does not constitute a binding offer.
By submitting the order, the customer makes a binding offer. The contract is concluded by:
explicit order confirmation by email
delivery of goods
handover of the rental item
commencement of consulting services
Sport Fleiss reserves the right to reject orders without giving reasons.
3 Prices and Payment
All prices are in Euro (€) including statutory VAT.
Payment is only possible in Euro (€).
Bank charges or currency exchange fees are borne by the customer.
4. Warranty / Liability for Defects
The statutory warranty provisions apply. In case of defects in the goods, the customer is entitled to repair or replacement. If this is not possible, the customer is entitled to a price reduction or rescission in accordance with statutory provisions.
5. Complaints and Returns
Complaints concerning defects are handled in accordance with statutory warranty provisions.
Returns for other reasons are accepted only as a goodwill gesture, provided the goods are unused, retain their original labels, and are accompanied by a valid proof of purchase (invoice)
B. Online Shop (Purchase of Goods)
1. Delivery
Delivery is made to the address provided by the customer.
Shipping costs are displayed during the ordering process.
Delivery times are non-binding unless expressly agreed.
2. Right of Withdrawal (Consumers)
Consumers can withdraw from the contract within 14 days without giving reasons.
The period starts upon receipt of the goods.
Withdrawal must be made in writing to: office@sport-fleiss.at or by post to Sport Fleiss GmbH, Schlossgasse 2a, 5630 Bad Hofgastein.
Exclusions from the right of withdrawal: custom-made products, opened hygiene items, and digital content after download has started.
3. Warranty
Statutory provisions apply.
For entrepreneurs: warranty period 12 months, notice of defects per § 377 UGB.
C. Sports Equipment Rental
1. Contracting Party
The contracting party is Sport Fleiss GmbH.
2. Rental Conditions
The customer confirms that they:
are of legal age and fully capable of contracting
have provided accurate information (e.g., ski binding settings)
The rental item will only be handed over after full payment.
A valid photo ID must be presented upon collection.
3. Duties of the Renter
Handle the rental item carefully
No unauthorized changes (e.g., binding adjustment)
No transfer to third parties
In case of loss or theft, the customer is liable for the replacement value if no insurance is taken out.
In case of theft, a police report must be provided.
4. Prices, Payment, and Discounts
Prices: All prices include taxes, less any optional discounts.
Payment Methods:
Credit card (Visa, Mastercard)
Payment is processed via PAYONE GmbH Austrian branch,
Am Belvedere 10, 1100 Wien, Österreich
Any other fees (bank charges, currency conversion fees, etc.) are borne by the customer.
Discounts: Online discounts or discount codes cannot be combined.
5. Cancellation / Withdrawal
Free cancellation: Up to 24 hours before rental start.
Late cancellation: Less than 24 hours before rental start, full rental price is charged.
Early return due to verified injury or illness will be refunded pro rata, provided the cancellation period is observed.
6. Theft or Damage to the Rental Item
Insurance: Generally insured against damage (except bicycles).
Deductible in case of theft:
Diamond category: € 750
Platinum category: € 500
Gold category: € 350
Silver category: € 200
Reduction of deductible: By paying a fee, the deductible is waived:
1 day rental: € 8
Up to 2 days: € 16
From 3 days: € 24
Police report: Required in case of theft; without it, the customer is liable for the replacement value.
Intentional damage: Customer bears repair costs; if repair is impossible, customer pays replacement value.
7. Binding Adjustment
Ski boots are adjusted to the ski bindings if both items are rented.
Adjustment complies with the safety requirements of ISO standard 11088.
8. Liability
No liability for any accidents.
Liability disclaimer especially for damages caused by incorrect customer information (e.g., binding adjustment).
Booking platform is provided without guarantee; no assurance of availability, function, or error-free data transfer.
Temporary unavailability does not establish liability.
9. Exchange
Model change within the booked category (Diamond, Platin, Gold): free of charge
Change to a higher category: surcharge according to the price list (payable on-site)

D. Consulting Services
1. Scope of Services
Scope is defined in individual agreement or service description
No legal or tax advice
Sport Fleiss may use third parties as assistants
2. Copyright
All documents remain the intellectual property of Sport Fleiss GmbH
Distribution or publication without written consent is prohibited
3. Liability
Advice is provided to the best of knowledge
Liability for customer business decisions excluded except in cases of intent or gross negligence
E. Vouchers
1. Purchase
Online (PDF), physical (voucher card), or on-site
Contract is concluded upon full payment
2. Validity
30 years from the issue date
No cash redemption
No replacement in case of loss or theft
3. Right of Withdrawal (Online Purchase)
Consumers can withdraw within 14 days of receiving the voucher
Already redeemed vouchers must be refunded proportionally
F. Data Protection
The privacy policy on www.sport-fleiss.at applies
G. Final Provisions
Exclusive Austrian law applies
Jurisdiction for entrepreneurs: competent court in Salzburg
Jurisdiction for consumers: legal residence
EU online dispute resolution platform: https://ec.europa.eu/consumers/odr
Sport Fleiss is not obliged and not willing to participate in dispute resolution.
